By accessing or using our services, you (the "User") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.

By accessing or using our services, you (the "User") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.

2. ELIGIBILITY AND AGE REQUIREMENTS

Brainwave Africa is an inclusive platform for all ages. However:

  • Users under 13: Must have the consent and supervision of a parent or legal guardian to create an account.

  • Guardianship: If you are a parent or guardian allowing a minor to use the platform, you agree to be bound by these Terms and are responsible for the minor’s activity on the platform.

3. NATURE OF SERVICE

Brainwave Africa e-Learning Platform is currently provided as a free educational resource. While the service is free, Brain Wave Africa Ltd reserves the right to:

  • Modify or discontinue any part of the service at any time.

  • Introduce "Premium" or paid features in the future, subject to updated terms.

  • Limit access to certain resources based on geographic location or account standing.

4. USER CONDUCT AND PROHIBITED ACTS

To maintain a safe learning environment, all users agree not to:

  • Harassment: Bully, harass, or intimidate other students or instructors.

  • Content Abuse: Upload or share content that is defamatory, obscene, or culturally insensitive.

  • Technical Interference: Attempt to bypass security, introduce viruses, or "scrape" the platform for data.

  • Academic Integrity: Use the platform to facilitate cheating or misrepresent their identity.

5. INTELLECTUAL PROPERTY RIGHTS

  • Our Content: All course materials, videos, graphics, logos, and software are the intellectual property of Brain Wave Africa Ltd or its licensors. You are granted a limited, personal, non-commercial license to view and learn from this content.

  • Your Content: By posting comments, forum entries, or assignments, you grant Brainwave Africa a non-exclusive, royalty-free license to display and distribute that content for educational purposes.

6. DATA PRIVACY AND PROTECTION

Your privacy is paramount. In compliance with the Ugandan Data Protection and Privacy Act (2019):

  • We collect only the data necessary to provide educational services (e.g., name, email, progress tracking).

  • We do not sell your personal data to third parties.

  • Please refer to our Privacy Policy for full details on how we handle your information.

7. LIMITATION OF LIABILITY

  • "As-Is" Basis: The platform is provided without warranties of any kind. We do not guarantee that the platform will always be online or error-free.

  • Educational Outcome: While we strive for excellence, Brain Wave Africa Ltd does not guarantee specific academic results or employment opportunities as a result of using the platform.

  • Liability Cap: To the maximum extent permitted by Ugandan law, Brain Wave Africa Ltd shall not be liable for any indirect, incidental, or consequential damages.

8. THIRD-PARTY LINKS

The platform may contain links to external websites (e.g., YouTube, research databases). We are not responsible for the content, privacy policies, or practices of any third-party sites.

9. TERMINATION OF USE

We reserve the right to suspend or terminate your account without prior notice if:

  1. You violate these Terms.

  2. Your account remains inactive for an extended period.

  3. We are required to do so by law.

10. GOVERNING LAW AND DISPUTE RESOLUTION

  • Jurisdiction: These terms are governed by the Laws of the Republic of Uganda.

  • Amicable Settlement: In the event of a dispute, parties agree to first seek an informal resolution by contacting support@brainwaveafrica.org.

  • Arbitration: If unresolved, disputes shall be settled through mediation or the competent courts of Uganda.

11. AMENDMENTS

Brain Wave Africa Ltd may update these Terms from time to time. We will notify users of significant changes via the email address provided or through a prominent notice on our homepage.
